Event planning & styling (incl Hire Goods) – Cancellation notice and forfeit of paid money

If you cancel less than 30 days before the event – there will be no refund from My Perfect Event. If you cancel more than 30 days before the event, My Perfect Event reserves the right to withhold the non-refundable deposit and any deposits paid to vendors etc.

I’m sure you can appreciate that a lot of planning, design, sourcing of items and talking to suppliers can happen well in advance of any event. Often we have spent a lot of hours planning your event, so if you unfortunately need to cancel close to the date, we will need to charge for the time that we have already spent on your event or party. Sometimes suppliers don’t refund deposits/fees, this is separate to My Perfect Event’s charges and refunds. If they are suppliers that we have organized on your behalf, we will talk to them and see what refunds or change of event date can be accommodated.

DIY Hire Goods Only – Cancellation notice and forfeit of paid money

If you can give us 30 days notice, then we’ll refund the full deposit/amount paid.

If you only give us 15-29 days notice, then we’ll only refund 50% of the amount paid.

If you give us 8-14 days notice, then we’ll only refund 25% of the amount paid.

Less than 7 days notice: No refund available.

All hired goods must be fully prepaid prior to delivery by us or collection by yourself. 

My Perfect Event reserves the right to terminate the hire agreement early in the event of a breach of these terms and conditions and for non payment.

The Legal stuff – Hirer’s Liability

The hirer is responsible for all goods hired from the time of delivery/collection until they are returned to My Perfect Event.  This includes using a commercial courier to collect and/or return the hired goods. This also includes having hired items delivered directly to a venue where the hire client may or may not be in attendance to receive the goods.  Any losses, damage or breakages will be charged to the hirer.  It is the responsibility of the hirer to protect the items during the time of delivery, use, storage or waiting period before pick-up.

Any person signing the documents for and on behalf of the Hirer hereby covenants with the Owner that he/she has the Hirer’s authority to enter into this contract on the Hirer’s behalf and is authorised by the Hirer to bind the Hirer to this agreement.

To the full extent permitted by law, all warranties, conditions and guarantees that may otherwise apply or be implied are excluded and My Perfect Event’s only obligation resulting from a breach by it or of any condition, warranty or guarantee that cannot be excluded is limited to replacing the goods or supplying goods similar to the goods, repairing the goods, paying the cost of replacing the goods or paying the cost of repairing the goods.

The hirer is responsible for maintaining appropriate insurance for the goods

The hirer is responsible, at their own expense, for maintaining any necessary insurance of the hired goods, for theft and damage of the goods in an amount not less than the full replacement cost of the goods; and for liability, property and casualty insurance coverage in amounts necessary to fully protect My Perfect Event and its goods against all claims, loss or damage whatsoever.

The hirer cannot hire out the goods to another person or business etc

My Perfect Event will not accept any contacts with other third parties. My Perfect Event will only do business directly with the person or business who originally hired the items from us.

The hirer indemnifies My Perfect Event from any legal claim arising out of the hire of our items.

The hirer accepts full responsibility for the use of the hired items.  My Perfect Event is not responsible for damage to any person or property arising from the use or misuse of items hired from us.

Release and Indemnity – The Hirer hereby releases My Perfect Event from, and agrees to indemnify My Perfect Event in respect of any third party claims, action, suits, demands, costs and expenses for damage or injury to person or property arising directly or indirectly out of the hire or use of the goods by the Hirer or the Hirer’s breach of any of these terms.

Reserve the right to choose not to do business with an individual or business

By seeking to do business with My Perfect Event, the hirer consents to My Perfect Event obtaining a credit report containing personal information about the Hirer and the Hirer’s guarantors pursuant to section 18(k)(1)(b) of the privacy Act 1988.

My Perfect Event reserves the right to choose not to do business with any individual or business as it sees fit.

Broken, lost or damaged goods

We realise that accidents do happen. As soon as an item is identified as being damaged or broken, the hirer must cease to use that item.  The hirer must notify My Perfect Event immediately upon the occurrence of any of these situations. The hirer must not attempt to replace or repair any item whatsoever. The hirer must take all reasonable steps to ensure no further damage occurs to the goods and prevent any damage to persons or property resulting from the hired goods. My Perfect Event is not responsible for any damage caused whatsoever from a damaged or broken or faulty item. We check all hire items upon their return to us for wear and tear, but please do let us know if there is an item that we need to review for safety sake.

Force Majeure

If My Perfect Event is unable at any time to perform any of its obligations whether wholly or partly by reason of any cause beyond its control (including without limitation, acts of God, inclement weather, strikes, lockouts, fires, riots, civil commotion or unrest, interference by civil or military authorities, local government, illness/disease or act of war), then My Perfect Event may give written notice (including via email) to that effect to the Hirer, giving full particulars of such force majeure in which case the obligations of My Perfect Event under these Terms shall, to the extent that they are affected by the force majeure, be suspended during the term of the force majeure. My Perfect Event shall not be liable for any loss or damage suffered by the Hirer as a result of any delays caused by such force majeure events.

Permits or special permissions

My Perfect Event is not responsible for obtaining or providing any permits associated with the planned use of the hire goods.

Disclaimer

My Perfect Event is not responsible for failure by the client to engage and maintain any vendors, recommendations, contracts, payments of vendors or programs etc.

We are not responsible for the handling/serving of food and/or drinks.

Quotations

A quotation is not a guarantee of the supply of equipment or any styling items etc.  Until we receive a paid deposit, this equipment is NOT booked or allocated to your event. We do ensure that the goods we are including in our quotations are available at the date of preparing the quote, but we cannot hold goods without payment.

Term/Termination

This agreement will terminate automatically upon completion of the services required by this letter of agreement.

Best Advice

Our advice is given in good faith and it is always your decision to accept our guidance. We cannot therefore accept responsibility for the consequences of such decisions or the performance of any/all vendors.
